This Privacy Policy explains how Magnetic Empire Enterprises Pty Ltd trading as Queen Energy ("we", "us", "our"), operating from Somerton Park, South Australia, collects, holds, uses and discloses personal information in connection with our website and any Program (coaching program, cohort, digital product, membership, or service) we offer.

We have prepared this policy with reference to the Privacy Act 1988 (Cth) and the 13 Australian Privacy Principles (APPs) it contains.

A note on the small business exemption. Businesses with annual turnover of AUD $3 million or less are generally exempt from the Privacy Act unless an exception applies (for example, providing a health service, or trading in personal information). Regardless of whether the exemption applies, we choose to handle personal information in line with the Australian Privacy Principles as a matter of good practice, and this policy describes how we do that. As the business grows past the turnover threshold, or if an exception applies, compliance with the Privacy Act becomes mandatory rather than voluntary.

2. The Personal Information We Collect

The personal information we collect depends on how you interact with us, and may include:

Identity and contact details — name, email address, phone number, and mailing or billing address.

Application and enrolment information — details you provide when applying for a Program, such as your business idea, work or industry background, and answers to application or discovery-call questions.

Payment information — billing details and limited payment information needed to process a purchase; full card numbers are collected and stored by our payment processor, not by us directly.

Communications — messages, emails, coaching notes, and content you share with us or within a Program community.

Website and technical information — IP address, browser and device type, pages viewed, and how you interact with our website (see clause 8, Cookies).

Marketing preferences — your subscription and engagement with our emails or social media.

We do not intentionally collect sensitive information (such as health, financial hardship, or other special category information) unless you volunteer it to us, for example in a coaching conversation, and we will only use sensitive information you volunteer for the purpose you shared it, or as otherwise permitted by law.

3. How We Collect Your Personal Information

We usually collect personal information directly from you, such as when you:

browse or make a purchase on our website; submit an application, inquiry, or discovery-call booking;

enroll in, or participate in, a Program; subscribe to our email list or engage with our social media pages; or contact us directly by email, social media message, or phone.

We may also collect information from third parties where reasonably necessary, such as our payment processor confirming a transaction, or an existing client referring you to us. Where practical, we will tell you at the time we collect your information, or as soon as possible afterwards, why we are collecting it.

4. Why We Collect, Hold, Use and Disclose Your Information

We collect, hold, use and disclose personal information to:

assess your application and enroll you in a Program; deliver a Program, including coaching sessions, community access, and support; process payments and manage billing, including installment plans;

communicate with you about your inquiry, application, purchase, or Program; send you marketing about our Programs, where you have consented or as otherwise permitted by law (see clause 5); improve our website, Programs and services, including through analytics; comply with our legal and regulatory obligations, including tax and consumer law obligations; and respond to complaints, resolve disputes, and enforce our Terms and Conditions.

We only use and disclose personal information for the purpose we collected it, a related purpose you would reasonably expect, or as otherwise required or authorised by law.

5. Direct Marketing and Electronic Communications

We will only send you marketing emails, SMS or other electronic messages about our Programs where you have opted in (for example, by subscribing on our website or ticking a consent box) or where you are an existing client and the message relates to similar Programs, consistent with the Spam Act 2003 (Cth).

Every marketing message we send will clearly identify Queen Energy as the sender and include a functional unsubscribe or opt-out mechanism. You can opt out at any time by using that mechanism, or by emailing us at [email protected]. We will process your request within a reasonable time, as required by law.

Opting out of marketing does not stop transactional or service messages we need to send you as part of delivering a Program you have purchased (for example, session reminders or payment receipts).

6. Disclosure to Third Parties and Overseas Recipients

We may disclose personal information to third-party service providers who help us run Queen Energy, including: payment processors and billing platforms (for example, Stripe), to process payments; website, funnel, email marketing, and community-hosting platforms (for example, Go High Level); analytics and advertising providers (for example, Google Analytics or Meta/Facebook), to understand website use and run advertising (see clause 8); our accountant, bookkeeper, or professional advisers, where necessary; and a government body or law enforcement agency, where required or authorised by law.

We do not sell your personal information to third parties.

Many of the service providers above are based overseas (commonly the United States), meaning your personal information may be stored on servers located outside Australia. Before disclosing personal information to an overseas recipient, we take reasonable steps, consistent with Australian Privacy Principle 8, to satisfy ourselves that the recipient handles it consistently with the Australian Privacy Principles, including by relying on the provider's own privacy and security commitments. By using our website and Programs, you acknowledge that your information may be handled overseas in this way.

7. Data Storage, Security and Retention

We store personal information electronically, using reputable third-party platforms (such as our website host, payment processor, and email or community tools) rather than on paper wherever possible. We take reasonable technical and organisational steps to protect personal information from misuse, interference, loss, and unauthorised access, modification or disclosure, including using secure platforms, restricting access to personal information to those who need it, and using strong passwords and account security practices.

No method of electronic storage or transmission is completely secure, and we cannot guarantee absolute security. If we become aware of a data breach that is likely to result in serious harm, we will notify affected individuals and the Office of the Australian Information Commissioner (OAIC) as required by the Notifiable Data Breaches scheme under the Privacy Act, where that scheme applies to us.

We retain personal information only for as long as reasonably necessary to fulfil the purposes described in this policy, including to meet legal, accounting, or reporting requirements. When information is no longer needed, we take reasonable steps to destroy it or permanently de-identify it, unless we are required by law to retain it for longer (for example, tax and financial records).

8. Cookies, Website Analytics and Tracking

Our website uses cookies and similar tracking technologies (such as pixels) to operate the site, remember your preferences, understand how visitors use our website, and, where applicable, show you relevant advertising on platforms such as Meta/Facebook and Google.

Most web browsers let you control or disable cookies through their settings. Disabling cookies may affect how our website functions. We may use tools such as Google Analytics and the Meta/Facebook pixel to understand website traffic and measure the effectiveness of our marketing; these providers may collect information about your device and browsing activity in accordance with their own privacy policies.

9. Access, Correction and How to Make a Complaint

Under Australian Privacy Principles 12 and 13, you may ask us for access to the personal information we hold about you, and ask us to correct it if it is inaccurate, out of date, incomplete, irrelevant or misleading. To do so, contact us using the details in clause 11. We will respond within a reasonable time; in most cases we will provide access or make the correction, but we may decline in limited circumstances permitted by law (for example, where access would unreasonably impact another person's privacy), and we will explain our reasons if we do.

If you are not satisfied with our response, you may lodge a complaint with the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au or by calling 1300 363 992.

10. Children's Privacy

Our website and Programs are directed at adults and are not intended for children. We do not knowingly collect personal information from anyone under 18. If you become aware that a child has provided us with personal information without appropriate consent, please contact us and we will take reasonable steps to delete it.

11. Changes to This Policy and Contact Us

We may update this Privacy Policy from time to time to reflect changes to our practices or the law.
